Announcement for the filling of a position of appointed lecturer in a Department of a Higher Educational Institution
On the basis of an interim order granted to us by the Council of State, our client was allowed to take part as a candidate in the procedure for filling the vacant post from which she was excluded because of the introduction of special conditions of exclusion in addition to those laid down by law.
Pursuant to article 173 of Law 4957/2022 and in order to cover teaching needs, the Ministry of Education, Religious Affairs and Sports issued a decision in 2023 on the allocation of 282 positions for the recruitment of appointed lecturers in Higher Educational Institutions for the academic year 2023-2024. Subsequently, a position of a lecturer in a Department of the opposing Higher Educational Institution was advertised, with a private fixed-term employment contract, for the spring semester of the academic year 2023 – 2024, subject to the approval of the appropriation by the Ministry of Education.
In particular, under the terms of the notice, candidates who either had one of the qualities explicitly mentioned in article 173 of Law 4957/2022 were excluded or had completed independent teaching in HEIs for three or more consecutive years, or were Members of the Associate Teaching Staff (C.E.P.) of the E.A.P.
As a result, our client was prevented from participating as she fulfilled the two additional negative qualities, since she has significant teaching experience in universities which clearly exceeds three years, while at the same time she was a member of the SEP of EAP as a lecturer with a fixed-term contract which expired in February 2024 (i.e. after the deadline for participation).
In the above circumstances, our client submitted a candidature with reservation and brought an action before the Council of State seeking the annulment of the notice in question and the suspension of its implementation by means of a request for an interim order. The interim order was granted and our client was allowed to participate in the procedure for filling the post in the normal way.
